EU Regulation CPR 305/2011 concerning entry and free circulation on the European market of construction products came into force in 2013 and definitively replaced CPD Directive 89/106/EEC.
The Regulation concerns all products that are produced to become a permanent part of a construction, be it a building or covin engineering work, and establishes that said products must comply with the specific requirements of a construction work: mechanical resistance and stability, safety in the event of a fire, hygiene, safety in use and environment, noise protection, energy savings, as well as the new concept of ‘sustainable use of natural resources’.
The Regulation better specifies the responsibilities of manufacturer, principal, importer and distributor and establishes that the manufacturer’s obligations include that of providing products’ guaranteed traceability in the event of any recall from the market if deemed not to meet the specifications set by CE Marking.
Furthermore, the Regulation introduces – replacing the Declaration of Conformity set forth by CPD – the Declaration of Performance (DoP), obligatory for all products covered by a harmonised standard, for which the manufacturer takes on responsibility for the stated performance that concerns intended use, essential features regarding the intended use, performance of at least one essential feature.
The Regulation establishes that only products for which the Manufacturer has drawn up the Declaration of Performance (DoP), that are CE marked and whose performance consistency has been verified and certified may be placed on the market.
The construction products placed on the market under Directive CPD 89/106/EEC before 1 July 2013, unless modified, are also deemed compliant with Regulation 305/2011, therefore it is not required to issue a new certificate. In these cases, manufacturers may draw up a Declaration of Performance (DoP) on the basis of the certificate of conformity or Declaration of Conformity issued pursuant to Directive 89/106/EEC, before 1 July 2013.
